Once added to the shopping cart, a Good and/or a Service is available for purchaseto the extent that stock is available for it. Â

7.2 By finalizing the Order, the Customer / Buyer agrees that all data provided by it, necessary for the purchase process, are correct, complete and trueat the time of placing the Order.

Â

7.3. By finalizing the Order, the Customer/Buyer consents that the Seller may contact him/her, by any means available/agreed by the Seller, in any situation where it is necessary to contact the Buyer.

Â

Thus, according to GEO no. 34/2014, the period for returning a Good or waiving a Service expires within 14 days from:

Â

  • the day on which the Customer/Buyer takes physical possession of the last Good – in case the Buyer orders in one single order multiple products to be delivered separately;

Â

Decrease in value of returned goods

Since, in the case of distance selling, the Customer/Purchaser does not have the opportunity to inspect the Goods prior to the conclusion of the contract, he/she has the right to withdraw from the contract. For the same reason, the Customer/Buyer is allowed to test and inspect the Goods he has purchased to theextent necessary to ascertain the nature, characteristics and functioning of the Goods.

Â

In order to determine the nature, characteristics and mode ofoperation of the Goods, the Customer/Buyer musthandle and inspect them in thesame way as they would be allowed to do in a real physical shop. For example: the Customer/Buyer is only required to try on an item of clothing, not to wear it on various occasions.

Â

The Customer/Buyer shall only be liable for any diminution in value of the Goods resulting from handling other than that necessary to determine the nature, qualities and functioning of the Goods. If the Client/Customer exercises the right of withdrawal after having used the Goods to an extent thatexceeds thelimit necessary to determine their nature, characteristics and functioning, the Client/Customer shall be liable for any diminution in value of the Goods.

Â

The accessories (user manuals, CDs, cables, etc.) contained in the box of the Goods and their original packaging are an integral part of the Goods. As a result, the Customer/C Purchaser is obliged, when exercising the right to withdraw from the contract, to return the Good in its original undamaged packaging, protected by wrapping with stretch plastic packaging foil or packed in a cardboard box (without labels affixed to it, without cuts, tears, etc.) and together with all its accessories.

Â

Returned goods showing signs of wear and tear (stains, scratches, bends, cracks, dents, dents, etc.) will be accepted only after bringing them back to conformity, involving the costs of sanitizing, cosmetizing, repairing, replacing any damaged parts and bringing them to a commercial form for sale as “Antiques”. The final valueshall be established on the basis of the value of the parts to be replacedand the value of the reconditioning labor, or as the difference between the original value of the new product and the resale value of the used product.

Â

Any diminution in the value of the Goods resulting from the handling of the Goods, other than that necessary to determine the nature, qualities and functioning of the Goods, shallbe the responsibility of the Customer/Buyer. For clarity, from the total price of the returned Goods, the Seller shall retain a sum of money representing the diminution in value of the Goods in the proportion of 5%-50% of the original value of the Goods, as applicable. The amount of the diminution shall be communicated to the Customer/Buyer upon receipt of the returned Goods.

Â

Â

7.10. If a Good and/or Service ordered by the Client/Customer cannot be delivered by the Seller, the latter will inform the Client/Customer of this fact and will refund the Client/Customer the amount of the Good and/or Service, within a maximum of 7 (seven) days from the date on which the Seller became aware of this fact or from the date on which the Client/Customer expressly expressed his/her intention to terminate the Contract.
